Data Protection Regulations

Data Protection Regulations for the Games-Career.com Brokerage Portal

With your order, we will collect your personal data and forward this information for the purpose of bringing you into contact with employers or job seekers. Against this background, it is imperative to remember: data protection is a matter of trust and your trust is important to us. For those reasons, we at Quinke Networks as the Operator of Games-Career.com ("Operator") will process your personal data in strict compliance with the law. We would like to acquaint you here with our method of collecting and processing data.

By calling up and using "www.games-career.com" ("Website"), you consent to these data protection provisions. You may withdraw any consent at any time with future effect. Should you have questions concerning the use of your personal data by us and our cooperating partners, please contact us (contact under No. 14).

1. Collection and use of your personal data; making the data available to third parties

1.1 Your visits to the Website remain anonymous. With each access to the Website by a User and call-up of a file, however, access data recording the event are stored in a protocol file on our server in anonymous form as follows: Internet protocol, IP address, page from which the file was requested, date, time, the type of browser and operating system, the site you visited, transferred volume of data, access status (file transfer, file not found etc.). These data serve to generate statistics that help us analyze the utilization of our services, to remedy shortcomings and to improve our service.

1.2 We fundamentally collect and use only personal data which you provided us with at the time of your registration to use the Website or for the use of fee-based services. Personal data are defined as those revealing information about personal and factual circumstances of the client.

1.3 When you register as a user, only your name, e-mail address and a password is stored so as to be able to send you appropriate offers or requests, or career info from the games industry. We treat these data confidentially and they will not be forwarded to third parties (potential employers, academic institutions or job seekers, etc.) unless we have your express written permission for this when you post your request or offer, curriculum vitae, photos, etc. and/or approve their release (see No. 1.4).

1.4 Games-Career.com is a brokerage portal for the games industry and sees itself as a clearinghouse for jobs, internships and academic/training offers, as well as other services for the games industry. Here, you have an option to avail yourself of cost-free or fee-based services. This includes the posting of offers and requests, the creation of a “Top” profile, such as a Top Employer profile, etc. In this context, you may post a request including your CV, details of your education and training, professional experience and skills, upload photos, certificates, references and other documents and provide additional details such as your full name, gender, age, nationality, contact address, e-mail address, phone number, etc. These uploaded documents will be made public upon your request and order and forwarded to potential employers. Posted data relating to offers, such as Top Employer profiles, details about the company, contact address, personnel officer and professional requirements will also be made public and forwarded to potential applicants [WER SONST?]. These published data can therefore be called up, used or stored by third parties worldwide. For these reasons, we aim to limit access to our database to authorised Users, but cannot guarantee that unauthorized third parties do not obtain access to the data. Please take care not to post sensitive data and information on our brokerage portal.

1.5 Personal data for performance of contract: When using our fee-based services, additional data such as full name, contact person, address, banking details, credit card numbers, etc. may be required depending on the service ordered. Your (personal) data are collected, used and stored for performance of contract. Likewise, it may be necessary to ask you for your name, address, e-mail address or phone number to process your requests or manage your account. These data will be treated confidentially by us and not shared with third parties without your permission except to the extent that they are needed for performance of contract, for processing your requests or managing your account.

1.6 We wish to point out at this time that inventory data, user data and settlement data within the scope of §§ 14, 15 TMG and/or § 28 BDSG are collected, processed and used as necessary for performance of contract.

2. Forwarding of (personal) data to third parties

2.1 Personal data which you provided us with for the purpose of registration and processing of orders will be made public by us or forwarded to interested third parties insofar as you have just ordered us to do so by posting a request or offer, see No. 1.4. The data are globally accessible via the Internet. Once we have published your personal data, statements and documents or forwarded them to a potentially interested party, we can no longer prevent possible misuse by third parties.

2.2 Otherwise, we will only forward your personal and/or contractual data to third parties, i.e. to partnership businesses, other companies cooperating with us, and external service providers to the extent needed for contract fulfilment and payment processing, as well as for the protection of other users or as is mandated by law. Payment processing is performed by external service providers (e.g. credit card companies, banks and other facilities). Your confidential interests will be taken into consideration in accordance with statutory provisions. External service providers are obligated to treat your data confidentially and securely and may use them only insofar as necessary to fulfil their task. We must point out that in compliance with statutory provisions we may be required to forward data (e.g. to public agencies for investigative purposes). The forwarding will always happen only insofar as this is necessary or legally prescribed.

2.3 In cases of arrears, we may commission a debt collection agency or attorney-at-law to enforce our claim of payment. For this purpose the required data will be forwarded and used in keeping with all data protection regulations.

3. Approval / E-Mail-Newsletter

At time of registration or by signing up for the newsletter you gave us your consent to regularly receiving a newsletter via e-mail with information about current offers, interesting articles dealing with subjects relating to employment, academic/vocational training and continuing education, and advertising material. You may have given us the following express statement of consent and we have included it in our records. You may at any time with future effect withdraw your approval of the use of your e-mail address for the transmission of information about news, current offers, and contributions on the subject of jobs, academic/vocational training and continuing education and advertising material (contact under No. 14). There is also the option at any time to cancel the newsletter subscription through a special link at the end of each newsletter.

Permission for use of your e-mail address for newsletters about the latest offers and interesting contributions and news and advertising material:

"I want to order the Games-Career.com newsletter and stay regularly informed about current offers and interesting contributions and news specific to the job market, academic/vocational training and continuing education. My e-mail address will not be forwarded to other businesses. I may cancel the newsletter without cost to me by notifying newsletter@games-career.com by informal e-mail. My consent to receiving future newsletters may be withdrawn by me at any time."

4. Processing and deletion

4.1 On our own initiative or upon your request, we may expand, correct or delete incomplete, incorrect and/or obsolete personal data, posted CVs and statements which have been stored by us at your request in conjunction with the Website’s operation.

4.2 You may review, change or delete the provided data and statements at any time by making the desired adjustments in your registered user profile.

4.3 Under the statutory provisions we shall promptly delete personal data following your order as Principal or legitimate agent unless overriding legal mandates governing storage requirements direct us otherwise.

5. Protection of your data

We will always make every reasonable effort to prevent unauthorized access to your personal data as well as the illegal use or falsification of those data and minimise the corresponding risks. But please note that the provision of personal data, whether in person, by phone or over the web is always fraught with risk and no technological system is completely immune to manipulation or sabotage.

6. Use of cookies

In addition to the personal information you provided, this site uses so-called "cookies", i.e. text files, or so-called "web beacons", i.e. graphics files which are stored on your computer. These are technologies which permit the collection of certain user-specific settings and technical information which can identify you. This information shows when and how users use the Website, enabling us to continually upgrade it. The use of cookies offers you the advantage of not having to repeatedly enter your personal data when you fill in various forms on the Website. The use of cookies is usual and common practice on many websites. Cookies are stored in your computer rather than our Website.

We use cookies only to read information on your hard drive that was stored there by a cookie from this site. If you do not wish to store cookies on your machine, or want to delete a stored cookie or be informed of its storage, you can activate respective settings on your browser. Check the ‘Help’ for your browser to find details of how to go about it. We must emphasize that in this case you might not be able to fully use all of the Website’s functions.

7. Google Analytics

The Operator uses Google Analytics, a web analysis service of Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, United States of America ("Google"). Google Analytics uses so-called "cookies", i.e. text files stored on your computer which facilitate an analysis of the Website’s usage by you. The cookie-generated information about your usage of this Website is generally transmitted to a Google server in the USA and stored there. If IP anonymisation is activated on this Website, Google will truncate your IP address within the EU Member States or other parties to the Agreement on the European Economic Area. Only in exceptional circumstances will a full IP address be transmitted to a Google server in the USA and abbreviated there. By order of the Operator, Google will use the information to evaluate your use of the Website, to compile reports about Website activities and to provide additional services associated with Website and Internet use on behalf of the Website’s Operator. The IP address transmitted from your browser within the framework of Google Analytics will not be commingled with other Google data.

You may deactivate the use of cookies with appropriate settings of your browser software; we hasten to point out, though, that in this case you may not be able to fully utilize all functions of Games-Career.com. You may furthermore prevent the collection of cookie-generated data relating to your use of the Website (incl. your IP address) and their processing by Google by downloading and installing the browser plugin available from the following link: https://tools.google.com/dlpage/gaoptout?hl=en.

8. Use of Facebook social plugins

The Operator uses "social plugins" ("plugins") of the social network www.facebook.com, which is operated by Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA ("Facebook"). The plugins are marked with the Facebook logo or the designation "Facebook Social Plugin". The list and appearance of the Facebook social plugins can be seen here : https://developers.facebook.com/docs/plugins/. Our Internet presence features such a plugin, by virtue of which your browser establishes a direct connection with the Facebook servers. The plugin’s content is transmitted by Facebook directly to your browser and from there incorporated in the Website. Hence, we have no influence on the volume of data that Facebook mines with the aid of this plugin and therefore advise you of what we know:

By incorporation of the plugin, Facebook is made aware of you having selected the respective page of our Internet presence. If you are logged in at Facebook, they are able to assign your visit to your Facebook account. When you interact with plugins, e.g. by pressing the "Like" button or writing a comment, the relevant information is transmitted directly from your browser to Facebook and stored there. Should you not be a Facebook member, there is still a possibility Facebook will learn your IP address and store it.

According to their own statements (https://www.facebook.com/help/?faq=186325668085084) Facebook will store the date and time of your visit to our site for 90 days, the actual Internet address where the social plugin is located and other technical data like IP address, browser type, and your operating system to further optimise Facebook services. The purpose and extent of the data mining, the processing and use of data by Facebook, as well as your respective rights and setting options to protect your private sphere can be found in Facebook’s data protection hints (www.facebook.com/about/privacy/)

If you are a Facebook member and don’t wish your data to be collected by Facebook through our Internet presence and commingled with your membership data stored at Facebook , you must first log out at Facebook before visiting our site.

9. Use of the Google +1 button

The Operator also offers you the opportunity to mark Website content with the "+1? button from Google and to recommend it via your Google Plus network. This service is operated by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Irland. The button is marked with a "+1?. If a web page of our Internet presence features the "+1" button, your browser will load it from the Google server and display it. We therefore have no influence over the volume of data called up by Google. According to their statements (www.google.com/intl/en/policies/privacy/), Google collects both the information you gave for certain content when you clicked +1 and the information on the site which you were viewing when clicking +1, i.e. the Internet address; also your IP address and other browser-related information. If you withdraw your +1 recommendation, this information will be deleted. All your +1 recommendations are listed on the +1 tab of your profile.

If you are logged in at Google, the information will be assigned to your account/plus account. Your +1’s can be inserted as pointers together with your profile name and photo in Google services, for instance in search results or in your Google profile or other locations on websites and advertisements on the Internet.

The awarding of +1 is a public process, i.e. anyone doing a Google search or calling up web content can potentially see that you gave a +1 rating to that content. So award a +1 only if you’re quite sure you want to share your recommendation with the whole world.

A click on the +1 button serves as recommendation for other users of the Google search results. You may publicly state your liking of our Website, or that you approve of it or can recommend it.

According to Google, they do not keep track of your web visits or permanently record your browser activities; nor do they evaluate your visits on a +1 interface in other ways. However, Google does store some data about your visit short-term, normally for some two weeks, for the purpose of system maintenance and troubleshooting. These data are not structured according to individual profiles, user names or URLs, however. Nor are these bits of information accessible to website publishers or advertisers. More information on Google can be found here. You will always be in control of your +1 content. All your +1’s can be administered over the +1 tab in your Google profile.

If you do not wish to have Google collect data on you via the Website in order to link them with your Google Plus account and/or Google account, you must log out at Google before visiting our site.

10. Twitter button

Furthermore the Operator also offers the opportunity to post comments etc. via Twitter. We use the service of Twitter, Inc., 795 Folsom St., Suite 600, San Francisco, CA 94107 with an appropriately configured plugin for this. The Tweet button lets you share web content through Twitter.

When the Internet page is created, the code of the Tweet button is retrieved by a Twitter server directly from your browser and incorporated in our Internet presence. We therefore have no influence on the volume of the data called up by Twitter. According to their statements, Twitter stores the transmitted news of the tweet and its metadata. We estimate that this includes date and time of the tweet, the actual, perhaps abbreviated Internet address where the Tweet button is, and further technical data such as the IP address, browser type, and your operating system. Twitter does not tell us how long they store the information.

11. AddThis-button

The Operator also uses AddThis, to facilitate the creation of bookmarks and the sharing of web content by the User. AddThis includes the use of cookies. The created data (e.g. time of use or browser language) are transmitted to and processed at Add This LLC, a subsidiary of the conglomerate Clearspring, 8000 Westpark Dr. , Suite 625, McLean, VA 22102, USA.

More information on data processing and protection by Add This LLC can be found at www.addthis.com/privacy. This also has in particular information on the type of processed data and their purpose. We have no influence on the volume of data mining by Add This LLC. THe Operator does not process the data involved.

You may opt out of the processing and use of your data by Add This LLC at any time by activating "Opt Out Cookies". More can be found under www.addthis.com/privacy/opt-out.

12. Advertising of third parties, links to other websites, Google AdSense

12.1 The Website may occasionally contain advertising of third parties and links (interactive pointers) to third-party domains for which we are not responsible. We especially have no influence on the content and design of the linked external pages and/or Internet domains which you reach through those links. Content and design of those domains as well as their compliance with personal data protection regulations is exclusively the responsibility of the various providers.

12.2 The Website uses Google AdSense, a web service by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Irland, which places ads by third parties on the Website. In tandem with the ads, Google may place cookies for read-outs and employ "web beacons" (small invisible graphics files) for the collection of information on the User’s hard drive. The information generated by the cookies/web beacons is transmitted to a Google server in the USA and processed there.

12.3 Occasionally, advertisers or firms will use technologies that transfer advertising appearing on our Website directly to your browser, so that your IP address is forwarded automatically. The advertisers or firms concerned may also use cookies and other technical means described under No. 6 to measure the efficiency of their advertising or to enhance its content. It especially promotes, but not conclusively, the assignment of Internet pages to certain interest categories in the context of their usage. No connection between this information and your name, address, phone no. or e-mail address is established. We do not have access to nor the means of control over these deployed cookies or other technical devices. The handling of data by these third parties is therefore not covered by the present data protection statement. Please therefore find out about their data protection standards from the individual providers. You may deactivate the use of cookies in your browser settings (see under No. 6). You also may avert the mining of interest-specific data and their categorisation by deactivation them on the page www.google.com/intl/en/policies/privacy/ads/.

13. Changes

We reserve the right to change these data protection standards or the site’s content at any time and without prior notice, or to change or block access to the site.

You may contact us anytime to have your user profile and your stored personal data corrected, blocked or deleted. We will also inform you at any time which of your data we have stored, including their background and the recipient of them, plus the purpose of their storage.
